1. Who we are

Reasonably Accountable ("the Publication") is published by Tertium Research Limited ("we", "us", "our"), a company registered in England and Wales.

These terms govern your use of www.reasonably-accountable.com and any free or paid membership you take out. By using the site or signing up, you accept them.

2. Memberships

We offer a free membership and one or more paid membership tiers. Paid tiers operate on a pay-what-you-want basis: the tiers are named to help you judge what is appropriate, but the tier you choose is your decision and all paid tiers give access to the same content unless we state otherwise on the sign-up page.

Paid memberships are billed in advance, monthly or annually as you select, and renew automatically at the end of each period until cancelled. Prices are shown at the point of purchase and are inclusive of VAT, where applicable.

Payments are processed by Stripe. We do not receive or store your card details. Your use of Stripe's services is subject to Stripe's own terms.

3. Your right to cancel

Statutory cancellation. As a consumer buying at a distance, you have 14 days from the day your membership starts to cancel and receive a refund, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Because we give you immediate access to members' content, that right ends once we have begun supplying it, provided you have expressly asked us to start immediately and acknowledged that you will lose the right to cancel. You give that consent and acknowledgement when you complete sign-up. If you would prefer to keep the full 14 days, email us at chris@tertium-research.com before signing up and we will arrange it.

Cancelling at any time. Separately from the above, you may cancel a paid membership whenever you like, through the account link in any email we send you or on the site. You will keep access until the end of the period you have already paid for, and you will not be charged again. We do not require you to write to us or give a reason.

Refunds. Beyond the statutory right above, we will refund an unused portion of an annual membership on request within a reasonable period. This is a matter of our discretion and does not affect your statutory rights.

4. Price changes

We may change membership prices. If we do, we will give you at least 30 days' notice by email before the change applies to your renewal, and you may cancel before it takes effect.

5. Content and your licence to use it

All content published on the Publication is owned by Tertium Research Limited or licensed to us, and is protected by copyright.

You may read, download, and print content for your own personal or internal professional use. You may quote short extracts with attribution and a link. You may not republish substantial parts of a post, place content behind another paywall, share members' content with non-members, or use the content to train machine learning models, without our written permission.

Members' content is licensed to you personally for the duration of your membership. Your account is for your use alone. If you would like a licence covering colleagues, a team, or an institution, email us.

6. Nature of the content

Content is commentary and analysis on health technology assessment, health policy, and related matters. It is not legal, regulatory, clinical, commercial, or investment advice, and it is not a substitute for professional advice on your own circumstances. You should not act, or refrain from acting, in reliance on it.

We take reasonable care to be accurate, but we do not warrant that content is complete, current, or free from error. Where we correct a material error, we will say so in the post.

7. Acceptable use

You must not use the site unlawfully, attempt to gain unauthorised access to it, introduce malicious code, or scrape it by automated means beyond ordinary search engine indexing. We may suspend or terminate a membership that breaches these terms, and where we do so without cause attributable to you we will refund the unused portion.

8. Availability

We aim to keep the site available but do not guarantee uninterrupted access. We may change, suspend, or discontinue the Publication or any tier. If we discontinue a paid tier we will refund the unused portion of your membership.

9. Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited.

Subject to that, our total liability to you in connection with the Publication is limited to the amount you have paid us in the 12 months before the claim arose. We are not liable for business losses — including loss of profit, business, contracts, or anticipated savings — as the Publication is supplied for personal and general professional interest rather than for any particular commercial purpose.

Your statutory rights as a consumer, including under the Consumer Rights Act 2015, are unaffected.

10. Data protection

We handle your personal data in accordance with our privacy notice, which
forms part of these terms.

11. Changes to these terms

We may amend these terms. Where a change materially affects your rights, we will notify members by email at least 30 days in advance, and you may cancel before it takes effect. The version in force is the one published here.

12. Complaints, law, and jurisdiction

If something has gone wrong, email chris@tertium-research.com and we will respond within five working days.

These terms are governed by the law of England and Wales. Disputes may be brought in the courts of England and Wales, and if you are a consumer resident elsewhere in the UK, in the courts of the part of the UK where you live. If you are a consumer resident outside the UK, nothing here deprives you of the protection of mandatory rules of the law of your country of residence.
